Until March 15, 2022, you need an Amusement Device Permit to build or alter an amusement device and a license to operate the device and give rides for entertainment purposes. The license you need depends on the type of device and how long the device is being used.

Important Update about New Local Law

Local Law 80 of 2021 repeals the licensing requirement for amusement devices (Permanent, Temporary, Portable) as of March 15, 2022. Even though amusement devices will not require a license after March 15, 2022, businesses still need to comply with laws enforced by the Department of Consumer and Worker Protection (DCWP).

Businesses must also continue to comply with other relevant federal, State, and City laws and rules.

You must have a Permanent Amusement Device License to operate a ride that carries passengers for entertainment purposes. Examples include roller coasters, Ferris wheels, and other thrill rides.

You must submit a separate application for each ride you operate.

Fee

The fee for the full one-year license term is $50 per device.

Expiration Date

The license expires on March 15 each year.

You must have a Temporary Amusement Device License to operate a ride for fewer than 15 days at a public event. Events include street fairs, carnivals, or block parties.

Types of rides that require a license include:

  • Ferris wheels
  • Tilt-a-whirls
  • Swings
  • Carousels

You don’t need this license if you have a Portable Amusement Device License.

Fees

The fee is $50 per device per event. The DOB inspection fee is $100 per device.

Expiration Date

You need a new license for each event. The license expires when the event ends.

You must have a Portable Amusement Device License to operate a truck-mounted or inflatable amusement ride on the vehicle that transports it. Examples of portable amusement devices include carousel rides and inflatable rides like the Moonwalk or Super Slide.

You must submit a separate application for each ride you operate.

Fee

The fee for the full one-year license term is $50 per device.

Expiration Date

The license expires on March 15 each year.

Inspections

Portable amusement rides that are truck-mounted must be inspected by the Department of Buildings (DOB) each time they relocate. To learn more, go to the Portable Amusement Ride Relocation Inspection page.

If you’re applying in person, you will have to complete an application and bring it to the Department of Consumer Affairs Licensing Center or the NYC Small Business Support Center.

About three months before your license expires, the Department of Consumer Affairs will mail you a renewal package.

You can complete and submit the application DCA sent you by mail or in person, or you can renew online. Once your license expires, you are considered unlicensed and you may get penalties if you continue to operate. If you don’t renew your license within 59 days of expiration, you will have to reapply for a new license.

Online

To renew online you need to have a DCA online account and a Personal Identification Number (PIN). The PIN is required to link information about your DCA records to your online account.

In Person

You can drop off your completed application and any required documents at the Department of Consumer Affairs Licensing Center or the NYC Small Business Support Center.
